Sublease: keep that in mind

• If you want to sublet a room as a tenant, you need the landlord's permission according to §540 BGB. So you need to have these first before you can negotiate any further.

• The landlord needs to know why you want to sublet the apartment. Economic or personal reasons are sufficient here to get approval. The landlord can only refuse if there are not enough rooms, i.e. one room per person. Or if the flat share resident is unreasonable for the landlord. But it is not enough that he just finds him unsympathetic.

• If the landlord agrees to a room in a shared apartment, it should be agreed in the contract that the residents of the shared apartment are exchangeable, i.e. that they can move out again without any problems.

Renting out rooms in shared accommodation - what should you watch out for?

• If the landlord only accepts one main tenant, then he is fully responsible for the timely payment of the rent. You should therefore discuss the rent, the extra costs and negotiate the deposit and put it in a contract.

• The contract does not only contain the regulations on rent, ancillary costs and deposit, but also details about the room and the shared use of the common rooms.

• You also have to include the notice period in the flat share contract. The notice period for shared apartments is usually 1 month. However, if you hand over the room fully furnished, a shorter deadline will be granted, namely on 15. of month.

• Also record the condition of the sublet room. As a sub-lessor, you should point out any deficiencies so that there are no nasty surprises when you move out and you have to repair damage that you did not cause.
