Contracts that are established by means of online orders are so-called distance sales contracts within the meaning of Section 312 of the German Civil Code (Bürgerliches Gesetzbuch).

  • The right of withdrawal discussed here is legally standardized in Section 312 b of the German Civil Code (BGB). Accordingly, the legislator already grants you a right of withdrawal if you, as a consumer, conclude a contract with an entrepreneur using a remote communication device.
  • The wording already shows that this regulation does not apply between entrepreneurs.
  • In addition, a revocation can be excluded by the general terms and conditions of the entrepreneur if the product is to be manufactured individually. Since the product is precisely tailored to the customer, it would not be possible for the entrepreneur to sell the goods to another customer after revocation. So pay attention to the terms and conditions for such orders.
  • Please note: You can cancel the trip with online travel bookings, but this is usually associated with considerable costs. The thought quickly arises that a right of withdrawal also applies in this case, but this is expressly not the case. Travel should therefore be chosen very carefully. How to cancel an online order 

However, do you have e.g. B. If you order a pair of trousers in the well-known mail order companies, you usually have no problems canceling the goods and exercising your right of withdrawal. To do this, proceed as follows:

  1. If possible, put the goods back together in the same way you received them and use the original bags and boxes for packing.
  2. You don't actually have to give a reason, but mail order companies in particular like to tick at least one of the reasons given on the return slip.
  3. Place the return slip in the package, seal it and tape it tightly so that the goods are not damaged when they are returned.
  4. When ordering, a return label is always included, which you stick on top of the package. You do not have to postage the return postage up to a value of 40.00 EUR. Most mail-order companies, however, waive goodwill, even for lower-value returns, on reimbursement of the shipping costs. Or take a look in your order documents to see whether the mail order business does not also offer a free return service.
  5. Just remember to keep the 14-day withdrawal period. This will always be set in motion if you have been properly instructed in writing about the possibility of cancellation. The earliest point in time is the receipt of the goods. If the instruction is missing, the deadline is not set in motion.
