Would you like to apply for basic security or are you already receiving it and are wondering whether you can own a car? That mainly depends on why you are receiving basic social security.

Whether you are allowed to own a car while you are receiving basic security depends on the reason for which you are receiving basic security. On the other hand, the question arises whether the car is only registered in your name, which means that you would be the owner, or whether you also have all the current ones costs take over. That would mean that you are the owner of the car too.

Requirements for receiving basic security

  • Pensioners and people who are permanently unable to support themselves, such as the disabled, receive basic security. This regulation is laid down in the fourth chapter of the twelfth book of the Social Security Code (SGB XII). Job seekers also receive basic security. This regulation is anchored in the second book of the Social Security Code (SGB II).
  • You receive basic security if your income or assets are insufficient for a living.
  • A cash amount of 2,600 euros is excluded from the credit. A married couple has a joint tax exemption of 3,214 euros.

Opportunities to own a car

  • Normally the recipients of basic security according to SGB XII are not allowed to own a car. The decisive factor here is who the actual owner is and not the holder. For example, if a car is registered to the disabled child, the parents can still be the owners of the car. You instruct this through the sales contract and others billsrelated to the motor vehicle and addressed to the car owner. In this case, the car does not count towards the disabled child's assets.

  • If the recipient of the social security benefit is also the owner of the vehicle, the chances are much worse that you will be able to keep the vehicle. According to SGB XII, the car counts as a creditable asset here. In certain circumstances, the welfare recipient can keep it due to particular hardship. What exactly is to be understood by "special hardship" is at the discretion of the responsible clerk.
  • However, if you receive basic security according to SGB II, you are entitled to your own car with a value of up to 5,000 euros. Accordingly, this does not count towards the eligible assets.

So it is not fundamentally impossible to own a car. It is important whether you have basic security according to SGB XII (e.g. B. Pensioners or disabled) or according to SGB II (e.g. B. Unemployed). In the first case, you are only allowed to have a car because of particular hardship. In the second, you are entitled to a car of reasonable value.
