  • The impairment caused by the building noise in the house must be considerable. Due to the construction noise, the rented apartment no longer has to correspond to the contractually guaranteed properties. In such situations it is always difficult to say in general the noise level and duration from which the defect is classified as "significant". Keep a noise log listing exactly when and for how long construction noise was heard. It would also be ideal if you could record the noise on a tape. These measures would make it easier for you to prove in the event of a legal dispute in order to get a rent reduction.
  • Find out how much has been reduced in other cases. To do this, you can google the jurisprudence or you can call the tenants' association and explain your case and ask. Flat rate can be approx. 20-60% of the basic rent can be reduced. The exact amount can only be determined in individual cases. If you set your calculation too high, it is not so bad, since the opposite can only be clarified in the event of a dispute and many landlords do not even let it get that far.
  • Calculate the amount that you want to reduce from your basic rent.
  • Write to your landlord that you want to reduce the price and provide him with the calculation and, if necessary, attach a copy of your noise log. Ask how long the construction work will continue and talk to us over the phone. So your landlord is informed in advance and can discuss everything with you in detail.
