Since 1. May 2011 you can legally employ nursing staff from Eastern Europe in Germany. In order not to expose yourself to the allegation of undeclared work, you must register your help. Watch out for dubious offers.

If you employ nursing staff from Eastern Europe in your private household, you are an employer. As such, you have duties.

Freedom of movement also for nursing staff from Eastern Europe

  • You no longer need a special permit from the employment agency for nursing staff from Eastern Europe. At least this applies to caregivers from Poland, Slovenia, Slovakia, the Czech Republic, Hungary, Estonia, Lithuania and Latvia. Romanians and Bulgarians are exempt. In these cases you have to contact the central foreign and specialist placement of the Federal Employment Agency by the end of 2013.
  • You can employ nursing staff from Eastern Europe as mini-jobbers (up to € 450 per month, as of 2012) or subject to social security contributions (over € 450 per month). Definitely you have to employment contract create.
  • Employ the assistant in Mini job, the procedure is simplified. Registration takes place via the Mini job center. Otherwise, the procedure described below applies to a higher gross salary of € 451 or more.

Domestic help employed subject to social insurance contributions

  • Describe the gross salary in the employment contract. The minimum wage for nurses is € 8.50 (old BL) and € 7.50 (new BL). Provide details about the working time, vacation, Notice period and the tasks in your household. Be sure to arrange a trial period.

  • You have to register your caregiver at the registration office.
  • Obtain an income tax card from the tax office and a company number. This is issued by the company number service of the Federal Employment Agency (phone: 01801-664466).
  • Make sure that your nursing staff from Eastern Europe has an A1 certificate from the foreign social security agency. Otherwise it works black.
  • Do not employ self-employed domestic help. These are often cheaper, but are mostly bogus self-employed. You make yourself liable to prosecution.
  • The gross remuneration also includes free board and lodging. The expenses are to be taken into account with the gross wage at 392 € per month.
  • Register your caregiver with a health insurance company.
  • Registration with the accident insurance is also mandatory (info phone: 0800-6050404).
  • If you are in need of care, you should apply for care allowance. The care allowance insurance pays a certain, contractually agreed daily rate.
