Construction BG: fill out the accident report
A sprained thumb, a broken hand or even a fatal accident - working life can be dangerous. If an accident occurs in the company - for example at a member company of Bau BG - you as an entrepreneur are obliged to report the accident or to fill out an accident report.
The obligation to report an accident in the company, which represents an insured event in the accident insurance, results from a corresponding provision in Book VII of the Social Code. As an entrepreneur, you shouldn't wait too long to submit an advertisement.
Fill out an accident report
- According to § 193 para. 1 SGB VII, entrepreneurs must report accidents involving the insured to the responsible accident insurance provider, if the insured person is unable to work for more than three days or is even killed as a result of the injuries. This also applies to insured persons who are not insured through employment, e.g. for volunteers who are insured against accidents through this honorary position.
- As an entrepreneur, you shouldn't take your time with such an accident report. Because according to § 194 para. 4 SGB VII, the report must be made within three days after the entrepreneur has become aware of the accident. According to the regulation, the same also applies if the entrepreneur has become aware of indications of an occupational disease.
- You should note that the works or staff council must notify you in accordance with § 193 para. 5 SGB VII must co-sign. A copy or You may also have to send a copy of the accident report to the authority responsible for occupational safety, s. § 193 para. 7 SGB VII.
Inform BG Bau
- For the notification you should use the forms provided by the employers' liability insurance association - including Bau BG. Because it can be assumed that these comply with the legal requirements resulting from § 193 para. 8 SGB VII.
- On the Bau BG website you can find the advertisement download. In addition to the personal details of the insured person and the company number, the precise description of the course of the accident is particularly important. Because this could possibly result in indications of an intentional causing of the insured event.

An accident report does not have to be filled out for every minor injury, but only under certain circumstances. In that case, however, it must take place within a certain period of time.
