Coming home in the morning bruised and off again in the evening? - Permanent work in the night shift is hardly an option for an apprentice. Because, depending on age, special protective provisions apply to him, which result from the Youth Labor Protection Act (JArbSchG).

In some apprenticeships, even a trainee will not be able to avoid showing up at the company very early when others are still asleep. For example, if you want to become a baker, you won't be able to sleep in very often. However, depending on the age, certain employment periods are also excluded in this area.

Night shift as a trainee depending on age

Many apprentices are still young people when they start their training. not yet 18 years old. Special protective provisions apply to them, so that the training does not lead to the development - for example through excessive demands on the working hours - is negatively influenced.

  • Young people who are not yet 16 years old are generally not allowed to work night shifts. Your working hours must be between 6 a.m. and 8 p.m., cf. § 14 para. 1 JArbSchG.
  • For young people who are already 16. Birthday, something else applies: Gem. § 14 para. 2 No. 4 JArbSchG, they may be employed in bakeries and confectioneries from 5 a.m. This also applies to agriculture.
  • Anyone who has turned 17 may have to get up a little earlier: In a bakery, an apprentice can work from 4 a.m.

Working at night according to the Working Hours Act

If an apprentice is of legal age, he no longer falls under the Youth Labor Protection Act, but the Working Hours Act (ArbZG) applies to him as for every other employee.

  • Night work is considered to be work if it is carried out for more than two hours during the night - i.e. between 11 p.m. and 6 a.m., in bakeries between 10 p.m. and 5 a.m.
  • Night shifts or Night work may only last up to ten hours in exceptional cases, usually it should not last longer than eight hours, cf. § 6 para. 2 ArbZG.
  • There may also be deviations from these maximum durations during night shifts, even if on-call duty is in the working time falls, cf. § 7 para. 1 No. 4 ArbZG.

Young people under the age of 18 are generally not allowed to work night shifts. Because special protective provisions apply to them.
