Limits for additional earnings with unemployment benefit 1

  • Those who receive unemployment benefit 1 can earn something on the side. However, the part-time job may generally not exceed 15 hours a week. Otherwise there is no longer any unemployment and the right to unemployment no longer applies, cf. § 138 para. 3 SGB III.
  • Anyone who earns an additional income in addition to receiving unemployment benefit 1 should observe Section 155 SGB III (as of 2012). An allowance of 165 euros is therefore not offset. It should be noted that taxes, social security contributions and incurred income-related expenses can be deducted from the additional income.
  • Anyone who has another job in addition to their main job within a period of 18 months prior to the onset of unemployment Has worked 15 hours a week - i.e. a part-time job - for at least 12 months, there is another limit for that Additional earnings.
  • According to § 155 Abs. 2 SGB III, the additional income is not taken into account up to the amount that was achieved on average in the last 12 months before unemployment. Compulsory insurance as a prerequisite

  • It can be important to know that the part-time job must have been carried out in addition to an existing compulsory insurance relationship. However, a compulsory insurance relationship does not only apply to a person subject to social insurance Employment, but in the case of self-employment, for example, can also be justified on application, see.   • Also self-employed who have taken out unemployment insurance and in addition to their self-employed activity, for example, one more 400 Euro job, this additional income can therefore be offset-free in the case of registration as unemployed and receipt of ALG 1 continue.
  • There is also a compulsory unemployment insurance relationship when receiving sick pay, cf. § 26 para. 2 No. 1 SGB III.

You can also earn additional money while receiving unemployment benefit 1. In the case of previous secondary employment, the tax exemptions may be significantly higher.
