Hartz 4 assumes neediness. Only those who are in need can social benefits expect. Anyone who owns a condominium must generally expect that this will be taken into account when calculating the Hartz 4 benefits.

Condominium must be appropriate to the number of residents

  • The protected property also includes a condominium that the Hartz 4 applicant lives in himself. Reference is made to a decision by the Federal Social Court (B 7b AS 2/05 R).
  • The judges based themselves on the living space of the condominium and the number of residents. The principle applies that the living space must be proportionate to the number of residents. If the living space exceeds this ratio, the Hartz 4 applicant can be obliged to look for a smaller apartment.
  • If 4 people live in the apartment, a living space of up to 120 m² is considered appropriate. Each additional person is considered with an additional 20 m².
  • For up to 3 people 100 m² and for 1 to 2 people 80 m² are appropriate. If only one person lives in the apartment, the living space of 80 m² is not reduced.

  • These limit values ​​apply in principle. In exceptional cases that deviate from these normal cases, the authority has plenty of leeway.

Hartz 4 recipients must make their own contribution

  • If the owner-occupied condominium is oversized, the authority expects that the owner as Hartz 4 applicant sells the condominium or, if applicable, a single room sublet.
  • If the living space significantly exceeds the specified limits (usually by more than 15%), the condominium as such is no longer protected and must generally be disposed of. Cases of hardship can allow exceptions.
  • If the owner does not use the condominium himself and rents it out, he must primarily sell or loan it. An exception is then again possible if the utilization is obviously uneconomical and the sales proceeds would be more than 10 percent below the intrinsic value of the apartment.
