Without expecting anything back, you stand up for one another - that goes without saying. Who needs a legal basis like that of a registered civil partnership? Wait - are they even available for men and women? Which advantages do entries have and which disadvantages can arise?

Before? No thank you! - Life partnerships between men and women

The registered civil partnership is the documentation of a marriage-like one relationship at a government agency. It has existed in Germany since 2001, although it is reserved for same-sex couples. For them, registration is the only option to give their relationship a legal basis.

  • A registered civil partnership between men and women only exists in a broad sense. Although it is a civil partnership, the registration is not officially named Civil partnership: The official talk is of a "marriage-like partnership", since 2005 also of one Community of needs. For the latter, the gender of the partner is irrelevant, as is the sexual orientation and the number of partners to be entered.
  • The reasons for the entry are similar to those of a civil partnership: the parties involved are concerned with rights, obligations and securities.
  • The partners agree privately that they would like to have the community of responsibility for rights documented by the state. The basis for registration is a cohabitation of more than one year.

Whoever lives in a relationship takes care of the other. However, this can be difficult under certain circumstances.

  • Partners without any kind of registered association officially have no responsibility for one another. That sounds like freedom to many ears. However, in certain situations it can become a problem.
  • In the event of illness, accident or even death, the surviving partner has nothing to report if the civil partnership state not as a community of responsibility in the sense of a marriage-like relationship or community of needs was entered.
  • For example, if one partner is in a coma, the second partner may not have a say in any measures. The doctor is also not allowed to pass any information on to him.
  • Just as the partners in an unregistered relationship have no co-determination rights in life-relevant matters, so after one they have separation also no entitlement to maintenance-like support. Until 2008, life partners of a registered relationship also went here empty-handed. There is now an entitlement to benefits after separation.
  • In the year mentioned, the Federal Court of Justice found that the registered heterosexual community of responsibility was underprivileged compared to the homosexual community. Since then, maintenance-like payments after the separation have been possible for registered partners, whereby gender and sexual orientation no longer play a role.

Doesn't that sound bad at all? True, but the responsibility for one another removes the responsibility for the individual from the state - for many a great injustice and a reason not to be registered.

Take responsibility - take responsibility from the state ?!

Anyone who is registered in a marriage-like partnership affirms that they are responsible for the other - not least the responsibility for care.

  • If a registered partner does not work, he is not entitled to any social benefits as long as his life partner is earning money. This is a great relief for the state. For a partnership with a child, on the other hand, this can be extremely unfavorable.
  • In terms of tax law, registration is also not worthwhile - the partners do not have any advantages here, unlike in marriage. Many opponents of the community therefore claim that registered partnerships bring you all the disadvantages of a marriage, whereas all advantages of the same are denied.
  • The advantage of codetermination in the event of illness and the even more up-to-date maintenance claim are not convincing enough for most partnerships. Both can be secured without registration - for example by notarized contract, living will and care power of attorney, to name just a few options.

Nonetheless, it turns out that the registered partnership between men and women is neither meat nor fish - therefore at least nothing for whole-or-nothing characters.
