Disputed property boundary

• The property boundary is the intersection of two adjacent properties. The boundaries are entered in the land registry office in the cadastral documents and are marked in the area by boundary stones.
• The boundary stones sit in the corners of the property and the boundary runs straight between them. However, the landmarks are not mandatory markers when building, as they can easily be moved by a resourceful neighbor. Only a boundary marked by an official surveyor is binding.
• The surveyor is guided by fixed and marked survey points. These can be viewed at the land registry office.

These guidelines apply to garden sheds on the property line

• In principle, you and your neighbor must adhere to a building limit of one meter; however, this does not apply to a fence. If you want to build closer to the neighboring property, then the neighbor must agree to this construction measure.

• Tool sheds with foundations must adhere to the development boundary when building them. Usually this is five meters from the public road. You can see the exact development boundary at the land registry office.

When the neighbor builds a tool shed on our fence

• First try to talk and clarify whether the neighbor has permission or is building illegally. Be polite and don't directly show our point.
• If your neighbor has permission, then your only option is to appeal to the neighbor's understanding. Explain to him what bothers you about the shed and what disadvantages it has on your fence.
• If he does not have planning permission for the tool shed, then politely point out that you do not agree with the construction. If he still refuses to refrain from construction, you can contact our municipal representative.
