Submit notice of dismissal due to retirement?
Those who are already looking forward to retirement should not sit back and relax. The retirement should be well planned, as there are some design options and annoying stumbling blocks. You do not necessarily have to submit the notice of termination because of the pension. Instead, the contract is usually canceled. That is the least of the challenge.
When you need to submit your retirement notice
- Note that many collective agreements have provisions on termination of employment when the employee retires. If a collective agreement is binding for your employment relationship, check whether there is such a regulation. These clauses usually state that the employment relationship ends without either party terminating it if the month expires in which the employee reaches the statutory retirement age.
- Usually, in addition to the collective bargaining agreements, many employment contracts also contain provisions on termination of employment due to retirement. Check your employment contract to see if there is such a clause. If this is the case, you do not have to write a notice of termination when you retire after the statutory age.
- If, on the other hand, you would like to retire earlier, you must inform the employer of this and terminate the employment relationship by giving notice. However, you should discuss this with your employer beforehand. In such a situation, a termination agreement is often concluded between the employee and the employer. Then you don't have to cancel either.
- If you quit because you are about to retire, you do not have to consider any other special features. The same requirements apply to the letter as if you were to terminate the employment relationship for any other reason. The letter must be in writing, sent to the employer and signed by you.
