In principle, you have to authorize a lawyer so that he can represent you in a legal matter. If you contact a lawyer, he will first give you a power of attorney, which you then have to fill out. However, you can also create a form yourself.
What the form of a power of attorney contains for the lawyer
- If you contact a lawyer, they will need a power of attorney from you stating that they can represent you. You will usually receive this form from the lawyer.
- If you want to create the form for the power of attorney yourself, it should first contain the heading "Placing orders and power of attorney for legal activities".
- After that, the name and contact details of the attorney to be authorized must be listed.
- The next point of the power of attorney must be the exact name of the case.
- Then a sentence has to be added, stating that the named lawyer is authorized by the client in the named matter. The client must be named with his address and date of birth.
- Now the form should list what the power of attorney relates to. It is important that the lawyer is authorized to litigate on behalf of the client, to withdraw counterclaims and to be authorized for all instances and follow-up proceedings. He must be able to submit applications, be able to make agreements on legal consequences and be authorized in criminal and administrative fine proceedings. He should be able to represent you even if you are absent.
- It is also important that he can conduct out-of-court negotiations for you and conclude a settlement.
