Hartz IV or The benefits according to SGB II are also available for 18-year-olds. However, everyone who is under 25 should know that there are particularly strict rules for them. These do not only refer to the possibility of having your own apartment financed by the job center.

No graduation, none education, no perspective - it can be dangerously tempting for the state to pay for its own living costs first. However, even if you have just come of age at the age of 18, you cannot immediately rent your own apartment if you cannot finance the rent yourself.

18-year-olds receiving benefits and moving

  • Because according to § 22 para. 5 SGB II, the need for accommodation and heating costs will only be met if the local authority or the job center has assured this before signing the contract for the new apartment. It is crucially important that the assurance must be given before the contract is concluded.

Sanctions when purchasing Hartz IV

  • For 18-year-olds or Under 25-year-olds also apply stricter sanction rules when receiving benefits.
  • Already in the event of a breach of duty according to § 31 SGB II - this includes, for example, the interruption of a reasonable integration measure - the job center can reduce ALG II to the benefits for accommodation and heating costs; In the event of a repeated breach of duty, Hartz IV can then be omitted completely, s. § 31a para. 2 sentence 2 SGB II.
  • Since this can lead to financially existence-threatening situations, the job center can secure the demand again or perform the services again if the person concerned agrees to comply with their obligations in the future.

Special rules apply to 18-year-olds who receive benefits in accordance with SGB II. This is particularly true with regard to possible sanctions.
