How much unemployment benefit you receive despite your additional income depends on whether you receive unemployment benefit 1 or unemployment benefit 2 ("Hartz IV"). However, the calculation is quite simple in both cases.

If you get Unemployment Benefit 1

You can find the legal basis for crediting additional income for unemployment benefits in § 141 SGB III.

  • As a recipient of unemployment benefit, you are allowed to work in which you work less than 15 hours per week (Section 119 subs. 3 SGB III). How much income you receive from the job is not relevant.
  • You can deduct the actual income from your income from a EUR 400 job. Of the remaining income, € 165 will not be offset, the rest will be fully offset against your unemployment benefit.
  • A calculation example: If you receive € 1,000 unemployment benefits and have an additional income of € 400, then you get (400, - € - 165, - € = 235, - €) as unemployment benefit or (1,000-235, - €) 765, - € plus your income from the 400 euro job.

How much money you have left with "Hartz IV"

For unemployment benefit 2 (Hartz IV) you will find the legal basis in Section 11b SGB II.

  • You can only claim the tax exemptions provided for by law if it is income from gainful employment. Profits from self-employment, however, are fully taken into account.
  • How much money you can keep from your income depends on how much additional income you have. The first € 100 is free of charge, you can keep 20% of the amount above. The rest will be offset against your Hartz IV.
  • A calculation example: If you earn exactly € 400, the first € 100 is free of credit. Of the remaining € 300, 20% remain free of credit, that is € 60. Of the € 400.00, € 100.00 + € 60.00 = € 160.00 are free of charge. So (€ 400 - € 160) € 240 will be credited to your Hartz IV.
  • Even if you only earn € 100 and the income is therefore not offset, you are still obliged to notify the job center of the income immediately.
  • The allowances for earned income apply to each individual member of the benefit community. Your partner can also claim the tax exemptions.
